U.S. court rejects El Chapo’s request to suspend his sentence

In a forceful decision, Judge Brian Cogan has denied El Chapo Guzmán’s appeal

El Chapo’s lawyers were attempting to overturn his conviction in an effort to get him out of prison.

He is being held in a SuperMax facility in Colorado.

In a memorandum dated December 26, Judge  Cogan, who presided over the trial against the leader of the Sinaloa Cartel, explained his decision.

El Chapo’s appeal was based on allegations that his constitutional rights had been violated.

Cogan refuted the appeal by stating that no substantial evidence was presented to support his allegations that he had been denied the opportunity to come to a plea agreement.

«Petitioner has not demonstrated adequate grounds for the appointment of counsel, so that motion is denied.»

It continues: «His habeas corpus petition is also without merit, and it is therefore also denied.»

El Chapo, seeking to overturn his conviction, argued that the habeas corpus statute was violated during his extradition.

He alleged that he was tried for different crimes than those listed in his extradition.

However, Judge Cogan dismissed this request, stating that it had «little foundation,» according to journalist Dolia Estévez.

The leader of the Sinaloa Cartel also stated that the conditions of his confinement in the United States were illegal.

He maintained that some of the evidence used against him was obtained illicitly, according to Milenio.

In addition, he stated that his own defense lawyers failed to seek a reduced sentence for him, including asking for a plea agreement.

Cogan, in his decision,  rejected El Chapo’s request to appoint a new lawyer to review these allegations.

The Mexican drug lord maintained that the trial against him was contrary to the principle of specialty, according to infobae

This establishes that he cannot be prosecuted for a different crime from the one that motivated his extradition.

His surrender to U.S. authorities was based on requests from district courts in Texas and California.

However, these were not related to the New York charges that ultimately resulted in his conviction, Milenio reported.

By rejecting El Chapo’s appeal, Judge Cogan has guaranteed he will continue serving his sentence in the ADX Florence maximum security prison.

This upholds the guilty verdict from one of the notorious drug trials in histlory.

In a firm decision, Judge Brian Cogan rejected El Chapo Guzmán’s requests to overturn his trial, confirming that he will continue serving his sentence in the United States.

Now that his appeal has been rejected, he seems to be out of options.
